Driver Crashes 4 Wheeler, Arrested for DWI, BIG SANDY, May 14, 2014 - At around 8:55 pm on May 13, 2014 a four wheeler accident was reported to the Polk County Sheriff's Office.  According to witnesses, they drove up on a situation where a four wheeler was turned on its side with the driver's leg pinned underneath on Magnolia Wood Road (a short distance from FM-1276 and FM-943).  Americare Ambulance Service was dispatched to the scene along with Deputy Cody Hardy with the Polk County Sheriff's Office and Trooper Darwon Evans with the Texas Highway Patrol.  The driver was freed from the situation and appeared unharmed.  As it turns out, the driver, Phillip Clifford Holmes, III, 33, of Livingston, was in fact physically unharmed.  After being checked by EMS personnel, Trooper Darwon Evans spoke with Holmes.  Holmes appeared to be intoxicated.  Trooper Evans administered a field sobriety test.  Holmes could hardly stand up, and his speech was slurred.  Evans placed Holmes under arrest and charged Holmes with driving while intoxicated.  Holmes is believed to have been impaired due to medication that he had been taking.  His four wheeler was recovered by friends and family.

In 2010, Phillip Holmes was arrested for driving while intoxicated after causing an accident on US-146.

When trying to perform tasks for a field sobriety test, Phillip Clifford Holmes, III was hardly able to even stand up.
Trooper Darwon Evans placed holmes under arrest for driving while intoxicated (Holmes' second). Evans is being assisted by Deputy Cody Hardy (left).
